§ 1. Who provides the service and how to reach us
1. LeadScanner is provided by VERTOM AI spółka z ograniczoną odpowiedzialnością, with its registered office in Warsaw, ul. Żurawia 45, 00-680 Warszawa, Poland, entered in the register of entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, 12th Commercial Division, under KRS number 0001248500, tax ID (NIP) 7011319192, REGON 545043929, share capital PLN 5,000.00 (the “Provider”, “we”).
2. Contact for everything, including complaints, data protection and the point of contact under Regulation (EU) 2022/2065 (Digital Services Act): [email protected]. We communicate in Polish and English.
3. These terms are available free of charge at useleadscanner.com/en/legal/terms, before the contract is made and for as long as it lasts, in a form that can be downloaded, saved and printed.
§ 2. Definitions
1. Service — the LeadScanner application available in the panel at app.useleadscanner.com and the website useleadscanner.com.
2. Customer — an entrepreneur or another entity that has entered into an agreement with us to use the Service. The person creating an Account represents that they are authorised to act on behalf of the Customer.
3. Privileged Customer — a Customer who is a consumer or a natural person entering into an agreement directly related to their business activity, where the content of that agreement indicates that it is not of a professional nature for that person (Article 385⁵ of the Kodeks cywilny (Civil Code), Article 7aa of the Act on Consumer Rights). Provisions marked as concerning a Privileged Customer apply only to such a Customer.
4. Account — individual access to the Service linked to an email address. Organization — the Customer's workspace, to which its team's Accounts, Sources, Leads and Points balance belong.
5. Source — a public group or public page (fanpage) on Facebook, a public subreddit or public search on Reddit, or a public search or public account on X, identified by the Customer for scanning. Post — a post or comment published in a Source. Author — the person who published the Post.
6. Scan — a one-time retrieval of the latest Posts in one Source and their assessment against the Customer's criteria. Lead — a Post that the Service assessed as matching the Customer's criteria, together with the Author's name or business name and a link to the Post.
7. AI Mode — assessment of Posts by a language model according to the description of the offer provided by the Customer, rather than solely by keywords.
8. Points — the unit of account for Scans. Plan — a subscription which, in each Billing Period, credits the Organization with a specified pool of Points and determines the Lead retention period. Package — a pool of Points purchased as a one-off. Billing Period — a month or a year, depending on the selected Plan option.
9. Price List — the current prices of Plans and Packages, published at useleadscanner.com#cennik. Prices are net prices; VAT at the applicable rate is added to each price.
10. Reply draft — a proposed reply to a Post prepared by the Service, which the Customer may use. The Service never publishes or sends it.
§ 3. What the Service does and what we do not promise
1. At the times selected by the Customer, the Service retrieves the latest publicly available Posts in the specified Sources — on Facebook, Reddit and X — assesses them against the Customer's criteria (keywords or, in AI Mode, the description of the offer), saves Leads in the panel and sends notifications about them through the channels configured by the Customer (email, SMS, Slack, webhook).
2. The Service reads Facebook as it is seen by a person who is not logged in. We do not log in to any Facebook account, use Customer accounts or request login details. We do not scan private groups, personal profiles or content available only after logging in.
3. The number of Posts that can be retrieved in a single Scan depends on how many a given service shows to a person who is not logged in, and is usually small. We do not guarantee any specific number of Posts or Leads per Scan. We do not provide a list of persons who reacted to a Post or full Post statistics.
4. Assessment in AI Mode is the result of an artificial intelligence system. It supports a decision; it is not a decision: it may be incorrect, may miss a Post or may identify a Post that is not a Lead. The Customer independently assesses whether and how to contact the Author.
5. Facebook, Reddit and X are owned by entities that are not parties to this agreement and do not authorise or support the Service. Each of them independently decides what it shows to a person who is not logged in, and may at any time change the layout of its pages, restrict the visibility of public content or block access from the addresses we use. We retrieve only what a service makes available to a person who is not logged in and do not circumvent technical safeguards. The availability of Sources is therefore beyond our control and is not guaranteed; for a Scan that fails for such reasons, Points are returned to the balance (§ 5(4)).
6. The Service is available in seven languages. We develop it on an ongoing basis; we give advance notice of changes that materially restrict existing features, as described in § 13.
7. We retrieve content from Reddit and X through an external provider of access to the public resources of those services, established outside the European Economic Area. The provider independently determines how it collects that content and, in relation to Authors' data, acts as an independent controller rather than as an entity acting on our behalf; we identify it in the list at useleadscanner.com/legal/subprocessors. We do not log in to Reddit or X, use Customer accounts or use their publishing, voting, following or private messaging features.
8. The Service may prepare a reply draft for a Lead. The draft is generated automatically using a language model, may be incorrect and is never published or sent by us. The Customer reads it before use, edits it and publishes it in its own name; from the moment of publication, the Customer is the sender of that statement with all the resulting consequences (§ 7(8) and § 10(2)).
§ 4. Technical requirements and the ban on unlawful content
1. Using the Service requires a device with internet access, a current version of one of the major browsers (Chrome, Firefox, Safari, Edge) with JavaScript and cookies enabled, and a working e-mail address. SMS notifications need a phone number; Slack and webhook integrations need the Customer's own configuration.
2. Entering unlawful content into the Service is prohibited, in particular: choosing as a Source a page the Customer has no right to access; entering in the offer description, keywords or names any content that infringes third-party rights, personal rights or the law; using the Service for harassment, discrimination, profiling on protected characteristics or any unlawful purpose.
3. The Customer may not: share an Account with anyone outside their Organisation; circumvent Point limits or the Service's safeguards; copy the Service or any part of it; resell Leads or make them available to third parties as a database of their own; use the Service to build a competing product.
4. The Customer keeps their login credentials secure. We recommend enabling two-factor authentication in Account settings. The Customer informs us without delay of any suspected unauthorised access.
§ 5. Contract formation, trial and Points
1. The contract is made when an Account is created: the registration form is completed, these terms together with the Data Processing Agreement (§ 9) are accepted, and the e-mail address is confirmed by clicking the link in the message we send. We record the date and the version of the terms accepted.
2. Every Organisation is entitled to one trial: 7 days and 120 Points on the conditions of the Growth Plan, with no card required. The trial ends after 7 days or when the Points run out. After it ends the Service charges nothing and does not start a paid Plan on its own; the Customer chooses a Plan and adds a card if they wish to continue. An Organisation that has used its trial will not receive another.
3. One Scan costs 1 Point and a Scan in AI mode costs 2 Points, regardless of how many Posts it reads. Points are deducted from the balance before a Scan starts. When the balance is insufficient the Scan is skipped and costs nothing.
4. Points are returned to the balance when a Scan failed for reasons on our side or on the side of the infrastructure we use (an outage, or a block of the kind described in § 3(5)). They are not returned when a Scan ran correctly but found no Lead — no Lead is a result, not an error.
5. Points from a Plan are valid until the end of the Billing Period in which they were credited and do not carry over. Points from Packs do not expire for as long as the contract lasts. The balance is always visible in the panel.
6. The Plan also sets how long Leads are kept: 30 days on Starter, 365 days on Growth and 730 days on Agency. The Post's text and the Author's data are counted from the Post's date, or - where the source service does not give one - from the day the Service read the Post; the Lead itself is counted from the day it was recorded in the Service. After that the Post's text and the Author's data are deleted automatically. Downgrading the Plan shortens this period for all Leads in the Organisation.
§ 6. Payments
1. Payments are handled by Stripe Payments Europe Ltd. The only payment method is a payment card. Card details are entered in the Stripe form embedded in the panel; we have no access to them and do not store them.
2. A Plan is a renewing subscription. This means that after every Billing Period the fee for the next period is charged to the card automatically, in the same amount, until the Customer cancels the Plan. We say so at the moment a Plan is chosen, and we confirm every charge by e-mail with an invoice.
3. A Plan can be cancelled at any time with one click in the panel, in the billing tab, without giving a reason. A cancelled Plan keeps working until the end of the paid Billing Period and then expires with no further charges. Packs are bought once and do not renew.
4. We issue VAT invoices electronically and send them to the invoice e-mail address set in the Organisation's settings; they are also available in the panel. The Customer agrees to receive invoices electronically. The Customer enters their invoice details in the panel and is responsible for their accuracy.
5. Prices may change. We announce an increase in a Plan's price by e-mail at least 30 days before it takes effect; until then the Customer may cancel the Plan. For a Privileged Customer the new price applies only if they expressly accept it; without acceptance the Plan expires at the end of the current Billing Period with no additional charges.
6. When a charge fails (for example, the card is declined), Stripe retries and we tell the Customer by e-mail and in the panel. If the fee has not been collected by the end of the paid Billing Period, the Plan expires: the Organisation loses the Points from the Plan, and its limits on Sources and team seats drop to the basic level until the Customer settles the payment or chooses a Plan again. Points from Packs remain.
7. Fees for Plans and Packs are non-refundable, subject to § 12 (a Privileged Customer's right of withdrawal) and to cases where a refund follows from the law or from our liability for improper performance of the contract.
§ 7. Authors’ data: who is responsible for what
1. Leads contain Authors’ personal data. We determine how Entries are read, which fields we record, how long we retain them, which model we use for assessment, what we remove from the content before providing it to the model, and which Sources must not be scanned. The Client determines which Sources to scan and according to which criteria, when and for what purpose it uses Leads. Since both sets of decisions make up a single purpose of processing, we are joint controllers in respect of Authors’ data within the meaning of Article 26 GDPR. The allocation of tasks is described in the joint controllers arrangement (§ 9), the essential content of which is publicly available.
2. The Client represents and warrants that: (a) it identifies only public Sources that are accessible without logging in; (b) it has a legal basis for contacting Authors—usually a legitimate interest in reaching persons who are publicly seeking its service—and has assessed whether that interest is not overridden by the Authors’ rights; (c) when using the reply draft, it reads it before publication, publishes it in its own name, and does not present it as a statement originating from us; (d) it will contact Authors exclusively in a lawful manner, in particular, it will not send commercial information or make a marketing call without the consent required by the ustawa Prawo komunikacji elektronicznej (Electronic Communications Law Act); (e) it will not use personal data—in particular, a first name, surname, email address, or telephone number—as a search phrase or as an assessment criterion.
3. It is prohibited to identify as a Source any groups, pages, subreddits, or searches whose subject matter itself reveals Authors’ special categories of personal data within the meaning of Article 9 GDPR: health status, including mental health and addictions, sex life or sexual orientation, religious or philosophical beliefs, political opinions, trade union membership, racial or ethnic origin, genetic data, and biometric data. We determine this prohibition, and it applies irrespective of the Client’s wishes. Sources concerning financial matters, including indebtedness and insolvency, are not covered by it, but a Client that identifies them takes into account the Authors’ particular situation when carrying out the assessment referred to in paragraph 2(b).
4. The Client may not use Leads for purposes other than making contact regarding its own offer, in particular for creating databases about individuals, assessing their creditworthiness, or making automated decisions concerning them.
5. The Client is responsible for the channels through which it receives notifications. The content of a Lead—including the Author’s first name and surname and an excerpt of the Entry—is sent to the email addresses, telephone numbers, Slack channels, and webhook addresses identified by the Client. The Client ensures that they are under its control and appropriately secured.
6. We are the contact point for Authors (Article 26(1) GDPR). If an Author objects to the processing or requests erasure of data, we will erase their data from all Organisations, including the Client’s Organisation, and block its re-collection (§ 9). A Client that receives such a request directly forwards it to us at [email protected] and does not contact the Author further regarding that matter. The Author may exercise their rights against each joint controller, irrespective of this allocation (Article 26(3) GDPR).
7. In the event of a breach of paragraphs 2–5, we may suspend Scans or the Account (§ 11). The Client will indemnify us against claims by Authors and supervisory authorities arising from the fact that it selected a Source or used a Lead or reply draft contrary to this section; this does not apply to a privileged Client to the extent that provisions of law exclude such liability, nor to the extent that liability arises from our own decisions described in paragraph 1.
8. The Client is responsible for the content that it publishes on the basis of the reply draft and for the effects that publication causes in the service in which it publishes it—including limiting the reach of the statement, its removal, or the blocking of the Client’s account by that service. The rules of the Reddit and X services restrict automatic replies to entries; therefore, the Service does not publish anything, and the decision whether and when to publish is made exclusively by a human on the Client’s side.
§ 8. Team and permissions
1. The Organisation's owner may invite team members and assign them roles. Every team member creates their own Account and accepts these terms as a user in their own name, but acts on the Customer's behalf.
2. The Customer is liable for the actions of people it has given access to as for its own. Removing a member from the Organisation revokes their access immediately.
§ 9. Personal data
1. We process the Customer's data and the data of persons acting on its behalf as controller, on the terms described in the Privacy Policy (useleadscanner.com/legal/privacy-policy).
2. We process Authors' data as joint controller together with the Customer, on the terms of the joint controller arrangement (useleadscanner.com/legal/joint-controller-arrangement), which is an appendix to the Terms and is entered into upon its acceptance. Its essence is publicly available at the same address. We publish the list of processors processing data on our behalf and the sources we use at useleadscanner.com/legal/subprocessors.
3. We publish information for Authors on what happens to their public Posts and how to object to it at useleadscanner.com/legal/notice-for-authors. The Customer provides that address to an Author who asks where it knows their post from or where it obtained their data.
§ 10. Liability
1. We make efforts to ensure that the Service operates without interruption, but we do not guarantee a specified level of availability. We may temporarily suspend the Service for technical work; we give advance notice in the panel or by email of planned interruptions longer than one hour.
2. We are not liable for the consequences of business decisions made on the basis of Leads, for the content of Posts or for the conduct of Authors. We are not liable for the content of reply drafts or for the consequences of their publication by the Customer, including the response of the service on which the Customer published them — restriction of reach, removal of the statement or blocking of the Customer's account. We are not liable for the unavailability of the Service resulting from actions of the owners of Facebook, Reddit and X, the provider of access to their public content, connectivity providers or force majeure.
3. In relation to a Customer that is not a Privileged Customer, our aggregate liability under the agreement, regardless of the legal basis, is limited to the amount of fees paid by the Customer during the 12 months preceding the event and does not include lost profits. The limitation does not apply to damage caused intentionally or to liability towards Authors arising under Article 82 GDPR.
4. In relation to a Privileged Customer, we are liable on the general terms arising from provisions of law; paragraphs 2 and 3 apply to that Customer only to the extent that they do not limit rights granted to it by mandatory provisions.
§ 11. Complaints, suspension and termination
1. Complaints about the Service may be sent to [email protected]. A complaint should name the Organisation, describe the problem and, where possible, give the date and time of the event. We reply within 14 days of receiving it, to the e-mail address it was sent from. No reply within that time means the complaint is accepted.
2. We may suspend Scans or access to an Account when the Customer breaches § 4 or § 7, when the security of the Service or of third parties requires it, or when a public authority orders it. We inform the Customer of the suspension and its reason by e-mail, unless the law prohibits us from doing so. The Customer may contest a suspension through the complaint procedure in paragraph 1. The suspension ends when its cause ceases.
3. We may terminate the contract with 14 days' notice if the Customer has not remedied a breach within the time set in our request, and without notice in case of a gross breach of § 7(3) or use of the Service for unlawful purposes. In that case the fee for the unused part of the Billing Period is not refunded, except to a Privileged Customer, to whom we refund it pro rata.
4. The Customer may terminate the contract at any time by deleting the Organisation in the panel's settings. Deletion takes effect after a 30-day grace period, during which the Account keeps working and the decision can be reversed; the Plan is cancelled immediately and Scans are paused. After the grace period we delete the Accounts, Sources, Leads and all data of the Organisation. We keep invoices and the data needed to issue them for the period required by tax law, and anonymised security log entries.
5. Before deletion the Customer may download a copy of the Organisation's data in the panel. The download link is valid for 24 hours.
§ 12. A Privileged Customer's right of withdrawal
1. A Privileged Customer may withdraw from a contract for a paid Plan or Pack within 14 days of concluding it, without giving a reason, by sending a statement to [email protected]. They may use the form in § 15 but do not have to. Sending the statement before the deadline is enough to meet it.
2. By choosing a Plan or Pack, a Privileged Customer requests that the service begin before the withdrawal period ends and acknowledges that, if they withdraw, they will pay for the service performed up to the moment of withdrawal. We calculate that amount in proportion to the Points used up to withdrawal against the Points covered by the fee. The rest of the fee is refunded within 14 days by the same method it was paid with.
3. The trial is free, so withdrawing from it involves no settlement; deleting the Organisation is enough.
4. A Privileged Customer may use out-of-court complaint and redress procedures, including the help of a municipal or district consumer ombudsman and mediation or arbitration at the competent voivodeship trade inspectorate. Information on these procedures is published by the Polish Office of Competition and Consumer Protection at uokik.gov.pl.
5. The declaration that the contract is of a professional nature, which the Customer may make at registration, is voluntary. Neither the contract nor any feature of the Service depends on it.
§ 13. Changes to the terms and to the Service
1. We may change these terms for important reasons: a change in the law or in its interpretation by courts or authorities; a change in the scope or operation of the Service, including adding or withdrawing features; a change of the providers we use; the need to improve security; the removal of ambiguities or errors; a change in the Provider's details.
2. We announce a change by e-mail and in the panel at least 14 days before it takes effect, saying what changes. A Customer who does not accept the change may terminate the contract with immediate effect until the day the change takes effect; the fee for the unused part of the Billing Period is then refunded pro rata. At the first login after the change takes effect we ask for it to be accepted.
3. For a Privileged Customer the notice in paragraph 2 is 30 days, and a change that materially and adversely affects access to or use of the Service entitles them to terminate the contract free of charge within 30 days of being informed of the change.
4. Changes that do not reduce the Customer's existing rights — new features, fixes, editorial changes — do not require the notice in paragraph 2.
5. The current version of the terms, with the date it applies from, is always available at the address in § 1(3). Earlier versions are provided on request.
§ 14. Final provisions
1. The agreement is governed by Polish law. In relation to a Privileged Customer, the choice of law does not deprive that Customer of the protection granted by provisions that cannot be excluded by agreement and that are in force in the country of their habitual residence.
2. Disputes with a Customer that is not a Privileged Customer shall be resolved by the court having jurisdiction over the Service Provider's registered office. The jurisdiction of the court in disputes with a Privileged Customer is determined by general provisions.
3. The Terms have been drawn up in seven languages. In the event of discrepancies, the Polish version is binding.
4. The appendices to the Terms are: the joint controller arrangement and the model withdrawal form (§ 15).
5. This version of the Terms is effective from 7 September 2026. It replaced the version of 2 September 2026, in which Authors' data were described as entrusted to us by the Customer.
